International court determines scope of duties on certain Chinese imports

The U. S. International Trade Commission determined that an engineered wood product fell within the parameters of the investigative probe into imports of Chinese millwork and wood moulding imported into the U.S.

As a result of the ruling, U.S. duties on Chinese wood mouldings and millwork products will remain in place. The trade court sustained the U.S. International Trade Commission’s conclusion that these imports are materially injuring domestic industry.

The commerce department, in 2021, imposed antidumping and countervailing duties on some of those Chinese products. The duties followed the Commerce Department’s determination they were being unfairly traded and subsidized and the ITC determining they were hurting U.S. industry.

CIT Judge Leo M. Gordon ruled Monday, March 28, to affirm the ITC's finding that American producers are being materially injured by imports of the Chinese goods, reported Legal360.com. The ITC's 2021 had paved the way for anti-dumping duties as high as 219.63% and countervailing duties reaching up to 252.29%.

Jeld-Wen Inc., the high-end door and millwork company, had argued that moulding and millwork made from laminated veneer lumber should not have been a subject of the inquiry.

The WoodworkingNetwork.com reported on Jan. 25, 2022, that the Commerce Department announced affirmative final determinations in the antidumping duty (AD) investigation of wood mouldings and millwork products from China, as well as the countervailing duty (CVD) investigation of wood mouldings and millwork products from China. Commerce also announced a negative final determination in the AD investigation of wood mouldings and millwork products from Brazil.

The investigation determined that exporters from China have dumped wood mouldings and millwork products in the United States at margins ranging from 44.60 percent to 230.36 percent.  In addition, Commerce determined that exporters from China received countervailable subsidies at rates ranging from 20.56 percent to 252.29 percent.

The DOC finding was announced on Dec. 29, 2020, with the notice, Wood Mouldings and Millwork Products From the People's Republic of China: Final Affirmative Countervailing Duty Determination filed in the Federal Register on Jan. 4, 2021.
